Terms of Use
- All customers who purchase through TICKETNAUTA acknowledge the limitations set forth in these Terms of Use.
- All sales made through the system are final. Purchase cancellations, changes, or refunds are not accepted.
- TICKETNAUTA does not ship tickets to your home. Phone service hours are 8:00 a.m. to 6:00 p.m., Monday through Friday. Saturdays and Sundays closed (until further notice).
- Refunds will only be issued for canceled events. If an event is postponed for reasons beyond TICKETNAUTA's control, previously acquired seats will be honored, or the decision will be subject to the event organizer. In any case, when an event is refunded, only the ticket price will be refunded, not any fees generated by the sale.
- While TICKETNAUTA regrets any inconvenience caused by such circumstances, TICKETNAUTA will not be responsible for any cost or damage that may result from the cancellation or postponement of a show. Likewise, the holding of events and performances for tickets sold to customers is the sole responsibility of the event organizers and venue operators; TICKETNAUTA will not be liable for any losses or damages caused to customers of these events.
- Refunds will only be issued for canceled events. In all cases where a ticket is refunded, only the ticket price will be refunded, not the fees generated by the sale.
Acceptance of the Terms and Conditions
Below are the terms and conditions you accept when performing the following actions: (i) registering as a user, (ii) purchasing, acquiring, or reserving a ticket for a published event. Considering Article 1803 of the Mexican Federal Civil Code, these Terms and Conditions are consented to tacitly, it being understood that pursuant to said article: “Consent may be express or tacit, as follows: I. It shall be express when the will is manifested verbally, in writing, by electronic, optical or any other technology, or by unequivocal signs; and II. It shall be tacit when it results from acts that assume it or authorize it to be presumed, except in cases where by law or agreement the will must be expressed explicitly.” Therefore, it is understood that registering your user will be sufficient for your consent to be express, or, when purchasing a ticket for an event, you will accept the terms and conditions tacitly.
1. General
I. These terms and conditions apply to all registered users, and to those users who, without being registered, acquire through the Digital Platform a ticket for events published by the Organizers (see Definitions).
II. The terms and conditions may be modified, amended, and/or repealed periodically without prior notice. The most recent version can be verified at www.TICKETNAUTA.com/terminos. Likewise, TICKETNAUTA will periodically send by email a copy of the updated terms and conditions, which shall be deemed accepted in accordance with the scenarios described herein.
III. By merely being a user of the Digital Platform, you consent that by accessing our portal you accept all TICKETNAUTA’s privacy, security, and regulations. You also state that you are of legal age and have capacity to contract; otherwise, please leave our site.
2. Definitions
I. Digital Platform: Refers to the portal and its Contents hosted at www.TICKETNAUTA.com through which the service of selling tickets by Organizers to Buyers for events of any nature is facilitated.
II. Contents: Copyrights, trademarks, trade names, distinctive signs, illustrations, graphics, audio clips, and/or video clips appearing on the Digital Platform.
III. Registered Users: Persons who, having accepted the terms and conditions, receive a username and password to access the Digital Platform as Organizer and/or Buyer. The Buyer will be subject to the provisions described in subsection V of this section.
IV. Organizer: Refers to registered users who use the Digital Platform to sell tickets for events under their responsibility. The Organizer may be an individual or a legal entity.
V. Buyers: Refers to users who use the Digital Platform to purchase tickets for an event of an Organizer. TICKETNAUTA will assign a registered user account that will only be activated at its discretion; however, the mere purchase, acquisition, or reservation of a ticket is sufficient for a user to be tacitly considered a Buyer and bound by these terms and conditions.
VI. For the previous subsection: (a) TICKETNAUTA will generate a downloadable document that must be signed by the Buyer and sent to [email protected]; (b) TICKETNAUTA reserves the right to stop selling tickets to the Buyer until the aforementioned document is formalized; (c) the Parties agree that payment of the ticket may be considered as consent to the rights and obligations contained herein.
3. Acceptance of the Terms and Conditions
A. The Buyer accepts the terms and conditions contained herein in accordance with Article 1803 of the Mexican Federal Civil Code.
B. Ticket purchases and relationship with Organizers: TICKETNAUTA is not responsible for organizing events, which are under the Organizer’s charge. The Buyer will have access to the Digital Platform and, having confirmed a purchase, acquisition, or reservation for an event, will receive a registered user that may be activated at TICKETNAUTA’s discretion; notwithstanding the foregoing, the purchase, acquisition, or reservation of a ticket is sufficient to give tacit consent to the Digital Platform’s terms and conditions.
C. Payment Methods for Buyers: The Buyer may use, as a payment method to the Organizers, those methods enabled in the event, which may include credit card, Oxxo stores, PayPal, or bank deposit, in accordance with these Terms and Conditions.
D. Consideration: The Buyer will not pay any fee to TICKETNAUTA for using the Digital Platform; however, they must cover the ticket price plus value-added tax and, where applicable, the purchase fee designated by the Organizer.
E. General: The Buyer acknowledges that TICKETNAUTA is only an intermediary in the ticket sale and acts on behalf of the Organizer to collect the total amount of the acquired ticket, including applicable taxes. The Buyer also accepts that TICKETNAUTA will act as a sales agent and, although TICKETNAUTA will facilitate the resolution of any claim, all refunds for canceled events will be borne by the Organizer, with TICKETNAUTA possibly acting as an intermediary for the refund.
F. Invoicing: All invoicing related to ticket sales to Buyers may (i) be carried out directly by TICKETNAUTA on behalf of the Organizer, or (ii) be carried out by the Organizer directly to the Buyers.
G. Service Limitations: The Service is limited to providing the tools and allowing the use of the Digital Platform and carrying out the tasks described above; TICKETNAUTA is not a banking or financial institution, and none of the services contained herein should be understood as such. All operations performed through TICKETNAUTA are deemed to be carried out in Mexico; TICKETNAUTA will accept transactions in Mexican Pesos and U.S. Dollars.
H. The Buyer will hold TICKETNAUTA harmless from any claim against Organizers, whether for event cancellation, poor experience during the event, damages, losses, and/or any other reason related to the services provided directly by the Organizer that could make the Organizer subject to a claim.
I. Changes to the Service: TICKETNAUTA reserves the right to unilaterally change any term, condition, scope, and/or characteristic of the service. Consent to the new terms and conditions will be deemed confirmed if the Buyer does not notify TICKETNAUTA of the refusal to accept the new terms and conditions within 5 business days from their issuance.
4. Terms and Conditions of Use
I. The Buyer receives a license to use the Digital Platform solely to browse its pages for their own information, review event information and advertising, and, where applicable, purchase tickets for events in accordance with the service description.
II. The user acknowledges that the use of the Digital Platform does not grant any ownership rights over it, any of its elements, or Contents, nor any of the exploitation rights that exist or may exist over the Digital Platform or the Contents.
III. All Contents are the property of TICKETNAUTA or third-party collaborators and no use or access to the Digital Platform grants the user any rights over them.
IV. The Contents and/or the Digital Platform may not be copied, reproduced, republished, sent, transmitted, transcribed, translated, stored, altered, downloaded, or distributed in any known or future medium, for any reason.
V. The user agrees not to use reverse engineering, decompilation, or disassembly techniques, nor modify or translate the Digital Platform, as it is protected by applicable industrial and intellectual property laws and treaties.
VI. The Buyer agrees not to use any robot, spider, automatic device, or manual process to monitor or copy the Digital Platform or the Contents.
VII. The Buyer agrees not to use any device, software, or routine, existing or to be invented, that interferes with or hinders the proper functioning of the Portal.
VIII. Any unauthorized use of the Digital Platform under these terms and conditions may result in the sanctions contained herein and those contemplated by the applicable legal framework.
IX. TICKETNAUTA reserves the right to take any actions it is entitled to by law to verify compliance with these Terms and Conditions.
X. If the Buyer violates the provisions of these terms and conditions and particularly this section, they shall indemnify TICKETNAUTA for all damages and losses caused due to the violation or breach.
XI. The Contents and advice expressed on the Digital Platform should be understood as guidance; therefore, TICKETNAUTA is not responsible in any way for their effectiveness or accuracy and is exempt from any contractual or extra-contractual liability with the Buyer.
5. Buyer Registration Obligations and Payment Methods
I. To purchase a ticket, users and registered users agree to provide true, accurate, current, and complete information. For non-registered users, such information will be required when selecting the purchase or reservation option; registered users will provide it in the site’s registration form. If you provide any false, incomplete information, or if TICKETNAUTA has reasonable grounds to suspect that such information is false, inaccurate, or incomplete, TICKETNAUTA shall have the right to suspend or terminate all your accounts and refuse your current or future use of the services.
II. As part of the site registration process and to simplify future purchases, the user may choose to create a registered user account or make the purchase without registering; notwithstanding the foregoing, TICKETNAUTA will assign a user to all buyers who make purchases through the Digital Platform, leaving to their discretion whether to activate the account and assign a password and username.
III. The Buyer is responsible for maintaining the confidentiality of their password and account and is fully responsible, without limitation, for all activities that occur under their account.
IV. The Buyer agrees to notify TICKETNAUTA immediately of any unauthorized use of their password or account or any other security breach, and to ensure that they log out at the end of each session.
V. TICKETNAUTA will not be responsible for any loss, damage, or liability arising from your failure to comply with this section or from any unauthorized access to, or use of, your account.
VI. In the event of any dispute arising between two or more parties regarding account ownership, the Buyer agrees that TICKETNAUTA will be the sole arbitrator of such dispute and its decision will be final and binding on all parties, which may include termination or suspension of any account subject to dispute.
VII. TICKETNAUTA is not responsible for event cancellations; it is the responsibility of Organizers to process the corresponding refunds. All sales are final and there will be no refunds to Buyers who do not attend events and/or cease to intend to attend an event for which they have already purchased a ticket.
6. Prices and Payments
I. The ticket price will be that published by the Organizers in the subdomains (.TICKETNAUTA.com) corresponding to the organized event, plus Value Added Tax and, where applicable, the fees designated by the event Organizers.
II. For purposes of these Terms and Conditions, the Parties agree that all payments related to ticket purchases must be made by Buyers under any of the payment models contemplated herein.
7. Disclaimer of Liability, Cancellation, and Refunds
I. TICKETNAUTA is not responsible for event cancellations; Buyers are responsible for verifying the status of the events for which they purchased or will purchase tickets.
II. In the event of canceled or rescheduled events, TICKETNAUTA will contact Buyers to inform them within a period not exceeding 48 (forty-eight) hours from the time the cancellation and/or date modification is known.
III. TICKETNAUTA is not responsible for any cost, damage, or loss caused by event cancellation or postponement; all responsibility lies with the Organizers and venue operators where the event was to be held.
IV. TICKETNAUTA will not be liable for losses or damages caused to customers of the events.
V. In case of an event cancellation, TICKETNAUTA will make every effort to facilitate the refund of the ticket price to the Buyer.
8. Taxes
All taxes generated by the use of the Digital Platform in relation to the purchase of tickets shall be covered by the party that gives rise to the taxable event, as applicable.
9. Buyer Obligations
I. The Buyer accepts that these terms and conditions grant rights and obligations for TICKETNAUTA and registered user Buyers in accordance with the specific clauses herein.
II. The Buyer states that they recognize the scope of these terms and conditions and that all information provided is truthful and that there are no legal impediments to contracting.
III. The Buyer acknowledges that if, for any reason, they have provided false, inaccurate, outdated, or incomplete information, TICKETNAUTA may unilaterally suspend or close the account and deny future use of the Service.
IV. The resale of any Service that TICKETNAUTA provides to the Organizer and/or the sale of the username and/or subdomain is strictly prohibited.
10. Account, Passwords, and Security
I. TICKETNAUTA will assign a Username to all Buyers who are not registered users; it will be the Buyer’s responsibility to decide whether to activate their account and set a Password.
II. The Username and Password serve as system identification and are used to authenticate whether the Buyer’s identity is correct.
III. For the purposes of these Terms and Conditions, the Buyer consents to use their username and password as equivalent to their handwritten signature; therefore, for all purposes, each time the Buyer formalizes the purchase of event tickets using their username and password, the sale will be deemed formalized at the time of payment.
IV. The user is responsible for all access to TICKETNAUTA.com with their Username and Password; any access made using the Buyer’s credentials will be considered as performed by the Buyer, regardless of whether the access was made by a third party authorized by the Buyer.
V. If the Buyer activates their user account, they will be responsible for protecting and securing their Username and Password. In the event that the Buyer becomes aware of or believes there has been any security breach—such as theft or unauthorized use of their Username and Password, or any information from their TICKETNAUTA account—they must notify TICKETNAUTA immediately.
11. Personal Data
The data provided will be treated in accordance with the Federal Law on the Protection of Personal Data Held by Private Parties and its regulations. By accepting these terms and conditions, you accept our Privacy Notice. The confidentiality of the data is guaranteed and protected by administrative, technical, and physical security measures to prevent damage, loss, alteration, destruction, misuse, unauthorized access, or disclosure. Only persons authorized by the Parties will have access to your data. All information will be safeguarded at each Party’s stated address, and the signatories will be responsible for the data.
12. Subdomains Assigned by TICKETNAUTA
I. The Buyer understands that TICKETNAUTA only facilitates the connection between the Organizer and the Buyer; therefore: a) For each event created, TICKETNAUTA assigns the Organizer a subdomain that will always be accompanied by www.TICKETNAUTA.com. The subdomain name is chosen by the Organizer, and TICKETNAUTA has no involvement in that choice.
II. The Organizer is solely responsible for the content included in the subdomain, and the Buyer releases TICKETNAUTA from any liability for legal violations and infringements. TICKETNAUTA may, at its discretion, request and/or modify the subdomain content without prior notice if it contravenes these terms and conditions. If such modification affects the Buyer’s ability to recognize the event regarding addresses and dates, TICKETNAUTA must inform the Buyer.
13. International Use
For all purposes, any use of the Digital Platform shall be deemed to have been made in Mexican territory. Any use outside the territorial jurisdiction of the United Mexican States is permitted; however, it will be considered as made within this territory.
14. Modification and Suspension of the Service
I. TICKETNAUTA reserves the right to modify at any time and without prior notice to the user the Contents, layout, information, configuration, and, in general, any part or aspect directly or indirectly related to the Digital Platform.
II. TICKETNAUTA may, without prior notice, suspend the Service to Buyers who have violated the terms and conditions.
III. TICKETNAUTA will not be responsible for event cancellations by the Organizer; it is the Organizer’s responsibility to make the corresponding refunds, with TICKETNAUTA being able to act as an intermediary for such purposes.
15. Ownership
I. TICKETNAUTA and the Buyer acknowledge their intellectual property rights. All intellectual property related to events published by the Organizers is the property of those Organizers, and TICKETNAUTA assumes no responsibility for any infringement generated by them in publishing their events. However, TICKETNAUTA enforces intellectual property policies that prohibit the total or partial distribution and/or publication of content protected by applicable intellectual property laws.
II. All users who accept the terms and conditions receive a temporary, non-exclusive license to use the Digital Platform for the purposes described herein. The license granted by TICKETNAUTA to the Buyer will be valid only during the term applicable to these terms and conditions.
16. Grounds for Rescission, Termination, and Penalties
I. Breach attributable to TICKETNAUTA: a) Lack of expertise in performing the agreed tasks.
II. Breach attributable to the Buyer: a) Non-payment and/or insufficient funds in the ticket payment method. If the payment method lacks funds, the Buyer will have a period of 5 days to make the payment. If, after 5 days, payment has not been made, the ticket will be released so that other Buyers may acquire it; b) Providing false information to TICKETNAUTA; c) Using the Digital Platform for purposes other than those contracted.
III. Not considered a breach: a) Any failure not reported by the Buyer to TICKETNAUTA.
IV. In the event of a breach, the affected Party must request the breaching Party to remedy the omissions. If within a period exceeding 10 days the remedy has not begun, these terms and conditions may be rescinded and the affected party may terminate the Service.
17. Taxes
The Parties acknowledge that all taxes caused, originated, or imposed in compliance with these Terms and Conditions must be paid by the party to whom such payment corresponds under applicable tax laws.
18. Term
The Parties agree that these Terms and Conditions shall be for an indefinite period and may be changed in accordance with the provisions herein. The Parties agree that by mutual consent they may terminate these terms and conditions, provided that the corresponding debts are covered.
19. Notices
Any notice, request, requirement, instruction, consent, or other communication given or sent under these terms and conditions must be published on the Site. All notices related to the service provided, terms and conditions of use must be sent to [email protected]. Regarding notifications to users, Buyers, and registered users, TICKETNAUTA may notify them at the email account they designated (i) when making the purchase, or (ii) when creating a registered user account.
20. Modifications and Waivers
The terms and conditions may be modified by TICKETNAUTA unilaterally and without prior notice.
21. Assignment
These terms and conditions shall be binding upon the Parties. The Parties may not assign, in whole or in part, their rights, obligations, or interests established herein without prior consent.
22. Entire Agreement
These Terms and Conditions constitute a single agreement between the Parties in relation to the obligations established herein. The Parties agree that it replaces any other agreement, whether written, oral, or previously published on the Site. In case of conflict between this agreement and previous agreements, the latest publication on the Site shall prevail.
23. Severability
Any term, condition, or obligation established herein that is null or unenforceable in any jurisdiction shall only be null or unenforceable in that jurisdiction, without affecting the validity or enforcement of the remaining obligations herein or their validity or enforcement in any other jurisdiction. Likewise, if any clause is partially null, the remaining obligations contained therein shall be considered validly agreed.
24. No Implied Waivers
The Parties agree that if either of them waives any of the rights or benefits to which they are entitled under these terms and conditions, such waiver must be in writing. Likewise, any waiver made by either Party regarding certain benefits or rights shall not be considered a waiver of other benefits or rights derived from these terms and conditions for which no express waiver has been made. Notwithstanding the foregoing, no delay in exercising the rights or benefits derived from these terms and conditions by either Party shall be considered a waiver thereof.
25. Headings
The clause headings in these terms and conditions are included solely for convenience and ease of reference and shall in no way be considered part of the terms and conditions nor affect the obligations contained herein.
26. Separate Businesses
The Parties acknowledge that these terms and conditions do not grant any privilege, right, or authority over the other businesses the Parties respectively have, but only the rights and obligations specifically provided herein. Therefore, neither Party may claim or demand greater rights in its favor other than those expressly established herein.
27. Governing Law and Jurisdiction
The Parties agree that, for all purposes related to the interpretation, performance, and enforcement of these terms and conditions, they submit expressly to the applicable laws and to the jurisdiction of the competent courts of the city of Mexicali, Baja California, Mexico, expressly waiving any other forum that may correspond to them by reason of their present or future domiciles or for any other reason.
